Statement of Retailer: gasoline and diesel retailers
Gasoline and diesel retailers can opt out of the regulations on wholesale pricing and retail mark-ups. Whether you opt out or not, you need to notify the Minister of Service Nova Scotia and your wholesaler or wholesaler retailer of your decision by completing the Statement of Retailer Form.
Use the Statement of Retailer Form to notify the Minster of Service Nova Scotia and your wholesaler or wholesaler retailer whether or not you want to opt out of the regulations on wholesale pricing and mark-ups.
Not opting out
You can decide to comply with the regulations on wholesale pricing and mark-ups. This means you agree to accept the fixed wholesale price and regulated retail mark-up on the regulated petroleum products you sell.
The Nova Scotia Utility and Review Board sets the retail mark-ups. Mark-ups can change.
Opting out
You can opt out of the regulations on wholesale pricing and retail mark-ups. If you do, you need to make an arrangement with your wholesaler or wholesaler retailer on a wholesale price and retail mark-up.
Who can use this form
Gasoline and diesel retailers need to use this form to opt in or opt out of the regulated wholesale price and retail mark-up established under the Petroleum Products Pricing Regulations.
If you have an existing contract with a wholesaler or wholesaler retailer, you need to submit the form and contract no later than 30 days after your existing contract expires.
If you don’t have an existing contract with a wholesaler or wholesaler retailer, you need to submit the form and contract no later than 30 days after you’re issued a Motive Fuel Retailer’s Approval under the Environment Act.
What you need to do
- Complete the form.
- Check the form for details on all required supporting documents.
- Send your completed form and supporting documents by registered mail or courier.
- Keep a copy of the form for your records.
- Send a signed copy of the form to your wholesaler or wholesaler retailer so they are notified of your decision. The wholesaler or wholesaler retailer has 15 days to countersign the form and return it to the Minister of Service Nova Scotia.
Cost
There is no cost to submit the form.

- legal business name of your wholesaler or wholesaler retailer
- address and phone number of your wholesaler or wholesaler retailer
- a copy of your contract with your wholesaler or wholesaler retailer
