Policy on identifying parties to an order: Residential Tenancies
The Identifying Parties to an Order Policy (Policy 15) explains that parties (applicant and respondent) to an Order of the Director must be uniquely identified to be registered with the Personal Property Registry or the Land Registry.
This policy outlines to landlords and tenants that an Order of the Director can be changed into an order of the Small Claims Court. The landlord and tenants involved in the order need to be uniquely identified to be registered with the Personal Property Registry or the Land Registry. To uniquely identify them, residential tenancy officers may ask for more information from the landlord or tenants to make sure they are properly identified.
The policy also describes the procedures that residential tenancy officers follow when preparing for a hearing. The officer:
- assesses the parties named
- may ask for more identifying information
- includes the identifying information in their decision and on the order
