The First Nations Reserves Policy (Policy 13) explains that the Residential Tenancies Act doesn’t apply to rental property on First Nations reserves.
This policy outlines how rental properties located on First Nations reserves don’t come under the jurisdiction of the Residential Tenancies Act. The act does apply to property located off reserve, even if the tenant or landlord is a First Nations person or First Nations band.
