Appeal Freedom of Information and Protection of Privacy (FOIPOP) decision to Supreme Court after review by commissioner (Form 10)
You can appeal a Freedom of Information and Protection of Privacy (FOIPOP) decision to the Supreme Court following a review by the Information and Privacy Commissioner.
Use Form 10: Appeal if you aren’t satisfied with the public sector body’s decision in response to the Information and Privacy Commissioner’s review of your Freedom of Information and Protection of Privacy (FOIPOP) request.
Report issued by commissioner
Make sure the commissioner has already issued a report and the public sector body has made a decision in response to that report (or failed to make a decision within 30 days).

Who can use this form
You need to use this form if you aren’t satisfied with the public sector body’s decision in response to the Information and Privacy Commissioner’s review of your Freedom of Information and Protection of Privacy request.
You have 30 days to file your appeal of the public sector body’s decision in response to the commissioner’s report.
If the public sector body fails to respond within 30 days, it is considered to have made its decision (refusal to follow the commissioner’s recommendations) on the 31st day after the commissioner’s report.
What you need to do
- Complete the form, except for Part B: Notice of Appeal.
- Confirm that there’s not a third party or if there is a third party, include a copy of the third party’s written consent.
- Provide all required supporting documents.
- Mail the form and supporting documents to the Prothonotary of the Supreme Court of Nova Scotia.
