Appeal a Freedom of Information and Protection of Privacy (FOIPOP) decision directly to the Supreme Court of Nova Scotia when there is no third party, or the third party agrees to the appeal in writing.
Use Form 9: Appeal if you aren’t satisfied with the public sector body’s (Tourism Nova Scotia, Develop Nova Scotia, Art Gallery of Nova Scotia or Nova Scotia Business Inc.) response to your Freedom of Information and Protection of Privacy (FOIPOP) request and there is no third party, or the third party agrees to the appeal in writing.

Who can use this form
You need to use this form if you’ve received an unsatisfactory decision on a Freedom of Information and Protection of Privacy request and want to bypass the Information and Privacy Commissioner review. There needs to be no third party, or the third party agrees to the appeal.
You have 30 days from the date of the public sector body’s decision (or lack of decision) to your Freedom of Information and Protection of Privacy request to file an appeal.
What you need to do
- Complete the form, except for Part B: Notice of Appeal.
- Confirm that there’s not a third party or if there is a third party, include a copy of the third party’s written consent.
- Provide all required supporting documents.
- Mail the form and supporting documents to the Prothonotary of the Supreme Court of Nova Scotia.
