Landlord’s Notice to Quit: Purchaser to Occupy Residential Premises - Sale of Residential Premises (Form DR2)

Landlords use Form DR2 to give tenants Notice to Quit when the landlord sells the property and the new owner or a family member is going to move in (occupy the premises).

Use Form DR2: Landlords Notice to Quit - Purchaser to Occupy Residential Premises (Sale of Residential Premises) to tell your tenant that they need to move out because you sold the property and the new owner or a family member is going to move in (occupy the premises).

Give notice

By law, you must give the tenant Notice to Quit when you sell a rental property that has 4 units or less and the new owner or family member is going to move in (occupy the premises).

The effective date of the Notice to Quit must be no earlier than 2 months after the date the tenant receives the notice. You need to give notice on or earlier than the day before the day in the month that rent is payable under the tenancy (lease) agreement.

If it’s a fixed-term tenancy (lease), the effective date of the Notice to Quit must be no earlier than the date specified as the end of the tenancy (lease) under the tenancy (lease) agreement.

Early termination by tenant

A tenant who receives a Notice to Quit can use Form DR2: Tenants Notice to Quit - Purchaser to Occupy Residential Premises (Sale of Residential Premises) to end the tenancy (lease) any time before the date specified in the notice.

Who can use this form

Landlords need to use this form to give a tenant Notice to Quit when the tenant needs to move out because the landlord sold the property and the new owner or a family member is going to move in (occupy the premises).

What you need to do

  1. Landlord enters into an agreement of purchase and sale to sell the property.
  2. All conditions of the sale have been met, except for the title of the property.
  3. Purchaser asks the landlord, in writing, to end the tenancy (lease) because the purchaser or family member of the purchaser is going to move in (occupy the premises).
  4. Purchaser provides the landlord with a sworn affidavit that the purchaser or family member of the purchaser is going to move in (occupy the premises).
  5. Landlord completes the Landlord’s Notice to Quit (on page 1 of the form).
  6. Landlord personally delivers the completed form and copy of the sworn affidavit from the purchaser to the tenant or sends it by registered mail.
